These Terms of Use (“Terms”) govern your access to and use of picturecanada.com (the “Site”), operated by 159490 Canada Inc. (“Picture Canada,” “we,” “us”). By registering an account, submitting content, or otherwise using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old to register an account, submit content, or purchase a membership on Picture Canada. By registering, you confirm that you are 18 or older and that all information you provide is accurate.
2. Family-Friendly Platform — Content Standards
Picture Canada is a family-friendly platform intended for a general audience, including families and young people who may browse public galleries. All photos, videos, and other content submitted to the Site must be appropriate for a general audience. The following is strictly prohibited, without exception:
- Nudity or sexually explicit content of any kind, including partial nudity presented in a sexualized manner.
- Any image, video, or other material that sexualizes, exploits, or endangers a minor in any way. Picture Canada has a zero-tolerance policy toward child sexual abuse material (CSAM) and any content that depicts or sexualizes minors.
- Content depicting or promoting violence, self-harm, or graphic injury.
- Hateful, discriminatory, or harassing content directed at any individual or group.
- Content that infringes another person’s copyright, trademark, privacy, or other rights.
- Content that is illegal under Canadian law or the law of the jurisdiction where it was created.
3. Zero-Tolerance Enforcement for Child Exploitation Material
If Picture Canada becomes aware of content that depicts or appears to depict the sexual exploitation or abuse of a minor, we will immediately remove the content, permanently terminate the associated account, preserve relevant records as required by law, and report the content and account to the appropriate authorities, including the Canadian Centre for Child Protection (Cybertip.ca) and law enforcement. We will fully cooperate with any resulting law enforcement investigation. There are no exceptions to this policy, and no appeal process for accounts terminated on this basis.
4. Content Moderation
All submitted photos and videos are subject to review before being published on the Site. We reserve the right, at our sole discretion, to reject, remove, or restrict access to any content, and to suspend or terminate any account, at any time and without prior notice, if we believe the content or account violates these Terms, applicable law, or is otherwise harmful to the Site or its users. If you believe content violates these Terms, you can report it to legal@picturecanada.com.
5. Your Content and License to Picture Canada
You retain ownership and copyright of the photos, videos, and other content you submit (“Your Content”). By submitting Your Content, you grant Picture Canada a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and promote Your Content on the Site and in connection with promoting the Site (for example, in marketing materials), for as long as Your Content remains on the Site or as reasonably needed afterward (for example, in archived promotional materials already published). You represent and warrant that you own or have the necessary rights to Your Content, and that it does not infringe the rights of any third party.
6. Copyright Complaints
If you believe content on the Site infringes your copyright, contact us at legal@picturecanada.com with a description of the work, the location of the allegedly infringing content, and your contact information. We will review and respond to good-faith complaints and may remove content pending review.
7. Accounts and Memberships
You are responsible for maintaining the confidentiality of your account and for all activity under your account. Membership plans, pricing, and included features are described on the Site at the time of purchase and are processed through our payment provider, Stripe. Membership fees are generally non-refundable except as required by law or as otherwise stated at the time of purchase.
8. Prohibited Conduct
In addition to the content standards above, you agree not to: impersonate any person or entity; use the Site for any unlawful purpose; interfere with or disrupt the Site’s operation or security; scrape, harvest, or misuse other users’ data; or attempt to circumvent content moderation or account verification (including OTP/identity verification).
9. Termination
We may suspend or terminate your account at any time for violation of these Terms, at our discretion. You may close your account at any time by contacting us.
10. Disclaimers and Limitation of Liability
The Site and its content are provided “as is” without warranties of any kind. To the maximum extent permitted by law, Picture Canada is not liable for any indirect, incidental, or consequential damages arising from your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
